Teenyday Terms of Use
1. ABOUT THESE TERMS
(a)These Terms of Use (Terms) govern your download, installation and use of Teenyday, supplied by Clever Iterations Pty Ltd (ABN 19 695 039 019), New South Wales, Australia (Clever Iterations, we, us or our). They cover the Apple edition and an Android edition where provided.
(b)By downloading, installing, accessing or using Teenyday, you agree to these Terms. If you do not agree, do not download or use Teenyday.
(c)The adult who installs or purchases the App is responsible for agreeing to these Terms and supervising use by a child. Children may use the App with an authorised adult. A child is not required to create an account or enter into a purchase agreement. The adult must meet the applicable store’s age and account requirements for downloading or purchasing.
(d)If you use the App for an organisation, you confirm that you have authority to agree to these Terms for that organisation. In that case, references to you include the organisation.
2. DEFINITIONS
“App” means the Teenyday app and an update we make available.
“Apple Terms” means the Apple Media Services Terms and Conditions, Usage Rules and other mandatory Apple terms that apply to the App.
“Australian Consumer Law” means Schedule 2 to the Competition and Consumer Act 2010 (Cth), as applied as a law of Australia and each State and Territory.
“Non-Excludable Right” means a right described in clause 12(a).
“Store Terms” means the Apple Terms for an Apple App Store edition or the applicable Google Play terms for a Google Play edition.
“Terms” means these Terms of Use.
“User Content” means the activities, wording, routines, plans, profiles, names, photos and preferences that you create or select in the App.
“Output” means a printable page, PDF or text that you generate or export using the App.
3. WHAT TEENYDAY DOES
(a)Teenyday is an adult-operated tool for making, editing and printing picture routines and family plans on your device. You choose the activities, words, pictures and page settings.
(b)Seven saved shared daily routines are free. You can continue editing and printing them; there is no weekly reset or recurring subscription. Optional Family toolkit features are described in clause 4 and in the App.
(c)The App does not require a Teenyday account or provide developer-operated cloud synchronisation. Editable plans and selected photos are stored locally. Purchase restoration restores eligible purchase access, not plans or photos from another device.
(d)Features, controls, printing and backup arrangements can differ between Apple and Android editions. Check the App and our support page for the edition you use. A PDF export preserves a printable page, not an editable plan.
4. PURCHASES AND STORE TERMS
(a)The App is free to download. One optional, non-consumable Family toolkit purchase adds unlimited routines and weekly plans, child profiles, names and personal photos, routine variants, clocks, reward pages and additional page colours. There is no recurring subscription. The applicable store displays the price and currency before purchase.
(b)Purchases are associated with the account and store used to buy them. Use that account and the App’s restore function while connected to restore eligible access. Apple and Google Play purchases are separate: a purchase on one does not unlock the other edition. Eligible Apple Family Sharing is subject to Apple’s account and family rules and applies only to the Apple edition.
(c)Apple processes Apple App Store purchases, supplies the receipt and collects applicable taxes. Google processes Google Play purchases under its applicable terms, supplies the purchase confirmation and may collect or remit taxes. We do not receive your payment-card details or store-account password.
(d)Refund requests can be made through the applicable store’s processes or by contacting us for assistance. Applicable law also governs refunds and remedies. Nothing in a store policy or these Terms limits any remedy against us under the Australian Consumer Law or another law that cannot be excluded. A refunded or revoked purchase may lose its associated paid-feature access.
(e)These Terms are between you and us, not Apple or Google. We provide Teenyday and its maintenance and support. Apple and Google are responsible for their own store and payment services under their terms; Apple has no obligation to provide maintenance or support for the App.
(f)For the Apple edition, Apple’s standard end-user licence agreement continues to apply. These Terms supplement it; they do not replace it or change the licence agreement configured in the App Store. Mandatory Apple Terms prevail to the extent of an inconsistency. The Google Play edition is also subject to the applicable Google Play Terms of Service.
(g)If the Apple edition fails to conform to an applicable warranty, you may notify Apple and Apple may refund the purchase price under its processes. To the maximum extent permitted by law, Apple has no other warranty obligation for the App. This does not limit an obligation or liability we have under applicable law.
(h)As between Apple and us, we are responsible for addressing claims relating to the App, including product liability, legal compliance, consumer protection and privacy claims, and for investigating, defending, settling and discharging claims that the App infringes third-party intellectual property rights.
(i)Apple and its subsidiaries are third-party beneficiaries of the Apple-related provisions of these Terms and may enforce them once you accept them.
(j)For the Apple edition, you represent that you are not located in a country or region subject to a United States Government embargo or designated as a terrorist-supporting country, and are not on a United States Government list of prohibited or restricted parties.
5. LICENCE
(a)Subject to these Terms and the applicable Store Terms, we grant you a limited, non-exclusive, non-transferable licence, revocable only in accordance with clause 14, to install and use Teenyday on compatible devices you own or control, or associated with your store account as permitted by the Store Terms. The Apple edition is licensed for Apple-branded devices; the Google Play edition is licensed for compatible Android devices.
(b)The licence permits personal, family and internal organisational use, including use by authorised caregivers or educators. It does not permit selling, renting, sublicensing, redistributing or commercially exposing the App or its software or bundled content as a separate product or service.
(c)You must not remove or obscure proprietary notices or copy, modify, reverse engineer, decompile, disassemble or extract the App or its components, except to the extent applicable law or applicable open-source licence terms permit the activity.
6. YOUR CONTENT AND LOCAL DATA
(a)You retain your rights in User Content and the Outputs you create. Nothing in these Terms transfers ownership of your User Content to us.
(b)You are responsible for having the rights, permissions and lawful authority to use names, photos and other User Content, including a child’s information, and to decide whether and with whom to share a printed or exported page.
(c)The App’s routine-making functions do not send User Content or Outputs to Clever Iterations. We do not use that content to train an artificial intelligence or machine-learning model. Information you choose to send to support is handled under our Privacy Policy.
(d)An exported page does not delete original photos, editable plans, shared files or copies held in device backups or other storage. You control those copies. Deleting local data or uninstalling the App does not cancel or refund a store purchase.
7. USE AND PRACTICAL LIMITATIONS
(a)Review an entire routine or Output before printing, sharing or relying on it, including names, photos, activities, dates and page layout. Match print settings to your printer and paper size. Printing, cropping and file handling depend in part on your device and the services you choose.
(b)Routines and reward pages are tools to use and adjust with your family. We do not promise a particular behavioural, developmental, educational or health result. They do not replace adult judgement, supervision or professional advice where needed.
(c)Keep a copy of important exported pages outside the App. Editable plans and device backups are not the same as exported PDFs. Android app backup is disabled; uninstalling can remove editable plans and imported photos. Apple device backups depend on your settings. We cannot retrieve local content for you.
8. ACCEPTABLE USE
(a)You must use the App lawfully and responsibly and respect the privacy, intellectual property and other rights of others.
(b)You must not use the App to facilitate fraud, impersonation, harassment, exploitation or unlawful content; introduce malware; interfere with the App or store services; or breach applicable Store Terms.
(c)These restrictions do not prevent lawful family, caregiving or internal educational use permitted by clause 5.
9. INTELLECTUAL PROPERTY
(a)Except for your User Content and third-party materials, rights in Teenyday and its software, design, illustrations, documentation and branding remain with us and our licensors, as applicable.
(b)These Terms grant only the limited licence in clause 5. No other right, title or interest is transferred to you.
10. PRIVACY
(a)Our Privacy Policy explains the App’s local content handling and what information we may receive through Apple or Google services, support communications and the Teenyday website.
(b)Please review the Privacy Policy before using Teenyday. It is available at https://teenyday.com/privacy/.
11. UPDATES, COMPATIBILITY AND AVAILABILITY
(a)We may make updates available to improve functionality, compatibility, privacy, security or legal compliance.
(b)Device and operating-system requirements may change. An update may be required for Teenyday to continue operating securely or compatibly with Apple or Google services.
(c)We do not promise that every feature will remain available indefinitely on every device. Where reasonably practicable, we will provide notice of a material reduction in functionality or discontinuation through the app, our website or app-store release information.
(d)We are not responsible for an interruption caused by Apple, Google, your device, your operating system or another third-party service that is outside our reasonable control. This clause does not limit your rights under the Australian Consumer Law.
12. CONSUMER GUARANTEES AND WARRANTIES
(a)Nothing in these Terms excludes, restricts or modifies a guarantee, condition, warranty, right, remedy or liability that cannot lawfully be excluded, restricted or modified (Non-Excludable Right), including under the Australian Consumer Law.
(b)We warrant that we will exercise reasonable care and skill in developing, supplying and supporting Teenyday. This does not promise a particular family, educational or developmental result, which depends on circumstances and your use as described in clause 7.
(c)Subject to clauses 12(a) and 12(b) and to the maximum extent permitted by law, we do not warrant that Teenyday will operate without interruption or error on every device or operating-system version. Your consumer guarantees and other Non-Excludable Rights continue to apply.
13. LIABILITY
(a)Nothing in this clause limits a Non-Excludable Right.
(b)To the maximum extent permitted by law, we are not liable for loss or damage to the extent it is caused by:
(i)your failure to exercise appropriate adult supervision or review the complete Output before relying on, publishing or sharing it;
(ii)your failure to comply with a legal, professional, contractual or organisational obligation;
(iii)your unlawful use or breach of these Terms;
(iv)a modification to Teenyday that we have not authorised; or
(v)an Apple or Google service, device, operating system, network, storage provider or other third-party product or service outside our reasonable control.
(c)Subject to clause 13(a), we are not liable for loss that was not reasonably foreseeable when you acquired Teenyday.
(d)Our liability is reduced to the extent that your act or omission, or the act or omission of a third party for whom we are not responsible, caused or contributed to the loss.
(e)Subject to clause 13(a) and to the maximum extent permitted by law, we are not liable for indirect or consequential loss, or for loss of profits, revenue, anticipated savings, business opportunity, goodwill or data, however arising.
(f)Subject to clause 13(a) and to the maximum extent permitted by law, our total aggregate liability to you for all claims arising out of or in connection with Teenyday and these Terms, whether in contract, tort (including negligence), under statute or otherwise, is limited to the greater of the amount you paid for Teenyday and A$1,000.
14. TERMINATION
(a)You may stop using Teenyday at any time.
(b)Your licence ends if you materially breach these Terms and do not remedy the breach within a reasonable time after we ask you to do so, where the breach can be remedied. We may end the licence immediately for a serious or unlawful breach that cannot reasonably be remedied.
(c)Teenyday is designed to operate without a Teenyday account or remote access by us. Termination of the licence does not represent that we can remotely disable an installed copy.
(d)On termination, you must stop using Teenyday and delete copies of the App in your possession or control, subject to any right you have under applicable law.
(e)Clauses 2, 6, 7, 8, 9, 12, 13, 14(d), 15(c), 16, 17 and 18 survive termination, together with any other provision that by its nature is intended to survive.
15. CHANGES TO THESE TERMS
(a)We may update these Terms for a future version of Teenyday or where reasonably necessary to address a change in law, security, technology or our operations.
(b)We will publish the updated Terms and effective date. If a material change affects your existing use of Teenyday, we will, where reasonably practicable, give at least 30 days' notice through the App, our website or app-store release information before the change takes effect. We may give shorter notice where reasonably necessary to address an urgent legal, security or technical issue. Where required by law, we will seek your agreement before a material change takes effect.
(c)A change will not reduce a right or remedy that accrued before the change took effect.
16. DISPUTES AND GOVERNING LAW
(a)If you have a concern about Teenyday, please contact us first so we can try to resolve it. This does not prevent you from contacting a consumer protection authority, privacy regulator or court at any time.
(b)These Terms are governed by the laws of New South Wales, Australia.
(c)The courts of New South Wales have non-exclusive jurisdiction. This clause does not prevent you from relying on a mandatory law or bringing a claim in another court where applicable law gives you that right.
17. GENERAL
(a)These Terms and the applicable Store Terms form the agreement governing your use of Teenyday.
(b)If a provision is void or unenforceable, it is severed to the minimum extent necessary. The remaining provisions continue to apply.
(c)Our failure or delay in exercising a right does not waive that right.
(d)A reference to including or for example does not limit the words that precede it.
